OBJECT
These General Terms of Sale govern the sale of products, presented on the web site, www.dpam.com, by a France-registered business (DU PAREIL AU MEME) to a physical, non-business person (the customer). As such, by placing an order through the above-mentioned web site, the customer implicitly accepts these General Terms of Sale, which constitute a legally binding agreement.
Orders are deliverable in the countries listed in the FAQ section on the web site, www.dpam.com. Orders may only be placed for products which are currently in stock.
Photographs of products shall not be contractually binding. Under no circumstances may DU PAREIL AU MÊME be held liable for any errors which may occur in the content of the web site, www.dpam.com.
PRICES
All prices are in Euros, inclusive of VAT (Value added tax). The applicable VAT rate is the rate currently in force in France, i.e., 19.6%. All prices are exclusive of any shipping and customs costs (for deliveries outside the European Union), which costs shall be borne by the customer. Should the VAT rate change, the prices of the products may be modified.
For deliveries outside the European Union, the prices appearing on bills are exclusive of VAT.Shipping costs are charged as a separate item and will depend on the weight of the ordered items, the country of destination and the method of transport chosen by the customer. PAYMENT
All payments shall be made on-line, by credit/debit card, when the order is placed. Only the following cards are accepted: CARTE BLEUE, VISA, EUROCARD and MASTER CARD.
Payments are secured through the CIC Bank's secure-payment service, which incorporates the SSL security standard.
All confidential data (16-digit card number, expiry date) is transmitted in encrypted (coded) form directly to the bank's server.
When a customer confirms an order:
- a payment request is transmitted in real time to the CIC Bank's secure remote payment service.
- The CIC Bank issues an authorisation request to the bank card processing network, G.I.E. cartes bancaires.
- the remote payment service issues an electronic certificate.
DELIVERY
For destinations within Metropolitan France (including Corsica), Customers can choose to have their parcels delivered (i) by post, to the address specified at the time of the order, or (ii) to the KIALA pick-up point specified at the time of the order (parcel weight and/or volume permitting). Postal deliveries are made from Monday to Saturday and generally take 2 to 5 working days. KIALA deliveries generally take 3 to 5 working days.
For other European destinations (AUSTRIA, BELGIUM, DENMARK, FINLAND, GERMANY, VATICAN CITY (STATE OF THE VATICAN CITY), IRELAND, ITALY, LUXEMBURG, THE NETHERLANDS, PORTUGAL, SAN MARINO, SPAIN, SWEDEN, UNITED KINGDOM), deliveries are made via the COLISSIMO Suivi Europe service, from Monday to Friday, and take between 3 and 10 working days depending on the destination.
For all other destinations (French overseas departments and territories included), parcels are delivered by CHRONOPOST, from Monday to Friday, and generally take between 3 to 10 opening days depending on the destination (since the date the parcel is sent).
IMPORTANT: Deliveries will not be made to post-office boxes.
Should the expected delivery date be exceeded by more than 7 days, the customer shall be entitled to refuse the entire order. In this case, any monies paid by the customer in respect of the order will be refunded in full, either by bank transfer or in the form of a credit note for use with a subsequent order, according to the customer's instructions at the moment of cancellation. In all cases, return costs shall be borne by the customer.
The merchandise shall be shipped at the risk of the purchaser, whose duty it is to assess the condition of the merchandise on receipt of the parcel, and who shall have 24 hours to notify DU PAREIL AU MEME of their reservations should items be found to be missing or damaged.

SPECIAL "FREE DELIVERY" OFFER
Special "Free Delivery" Offers allow customers to have their orders shipped to them free of charge if their purchases exceed a threshold amount advertised on the web site, www.dpam.com.
Special "Free Delivery" Offers are only valid during the periods specified on the web site, and for deliveries to destinations in Metropolitan France and in the European countries specified above in the DELIVERY section).
SATISFIED OR YOUR MONEY BACK
The Customer shall be entitled to return the ordered products, for refund or exchange, within 7 days of receipt of the parcel. All products must be returned with their original labels. Any payments made by the Customer in respect of the order will be refunded in full within thirty days, either by bank transfer or in the form of a credit note for use with a subsequent order, according to the Customer's instructions at the moment of cancellation. All return and re-shipment costs shall be borne by the Customer.
If the delivered items do not correspond to the original order, the provisions mentioned above shall apply, and in this case, all return or re-shipment costs shall be borne by DU PAREIL AU MÊME.
In any case, and at the Customer's request, DU PAREIL AU MÊME undertakes to exchange any product purchased on the web site, while stocks are available, or to refund the cost thereof, in as short a time as possible.
Products may also be exchanged, regardless of the reason, and again within 7 days, in any DU PAREIL AU MÊME store in metropolitan France (excluding Corsica) which carries the product to be exchanged in its range (childrenswear, babywear, footwear). Products will not be exchanged unless proof of purchase (bill) is provided. No refunds shall be made in stores.
RETURNS
When making a return, the order number must be clearly specified, as well as the reason for the return and the preferred method of refund (credit not or cash refund).
PERSONAL DATA
On placing their first order, the Customer is given a personal code, which can subsequently be modified. The new personal code must be at least 6 characters long. The personal code may be used when ordering products to save the Customer having to enter their personal details with every order. The personal details referred to here do not include banking details, which must be entered manually with every order. The personal code can also be used to view pending orders.
The Customer may opt to receive e-mail notification of special operations on the web site.
The data collected by DU PAREIL AU MÊME on www.dpam.com is intended for its own internal use, but may also be used by for commercial purposes and/or transferred to third parties who may use such data for commercial purposes.
The Customer may either give or refuse consent to the use of the collected data as part of the DU PAREIL AU MÊME customer file and to its use by third parties.
Pursuant to the French Data Protection Act of January 6th, 1978 (known as the loi Informatique et libertés), the processing of nominative data collected on www.dpam.com has been declared with the French data protection authority, CNIL. Moreover, the Customer may, at any time, exercise his/her right to access, rectify or delete any personal data collected by DU PAREIL AU MÊME on www.dpam.com by sending an e-mail request to: serviceclient@dpam.fr
As part of the fight against Internet fraud, information concerning the Customer's order will be forwarded to FIA-NET S.A. for verification.
As such, information concerning your order will be automatically processed by FIA-NET S.A. The purpose of such processing is to analyze e-commerce transactions at a certain level in an effort to prevent credit/bank card fraud.
FIA-NET S.A. and the merchant from whom you made your purchase are the recipients of the data concerning your order. The non-transmission of data concerning your order will prevent the completion and analysis of your transaction.
In the event of a non-payment due to the fraudulent use of a credit/bank card, the details concerning the order associated with the non-payment will be recorded in a payment incident file administered by FIA-NET S.A. Specific processing is also activated by irregular declarations or anomalies.
Participation in the "verified site - premium site" operation: Your purchase on dpam.com entitles you to take part in FIA NET S.A.'s "verified site - premium site" operation. . By answering two customer satisfaction questionnaires--to help us measure the quality of service provided during your purchase, you will be able to share your personal online shopping experience with us and with the wider community of internet users through the FIA NET web site. These questionnaires may either be sent by e-mail, by FIANET or DU PAREIL AU MÊME, or they may be displayed in a pop-up window following your purchase. The information gathered from these two questionnaires will be automatically processed by FIA NET S.A. The Customer is under no obligation to answer the questionnaires and failure to do so will have no impact whatsoever on the processing of your order. FIA NET S.A. and dpam.com are the recipients of the nominative data collected through these customer-satisfaction questionnaires. Non-nominative data will be exploited by FIA NET S.A. in accordance with regulations currently in force, and in particular with regulations concerning the protection of personal data. SETTLEMENT OF DISPUTES
The parties hereto accept and agree that these General Terms of Sale shall be governed by the laws of the Republic of France.
Any disputes arising between the parties in connection with these General Terms of Sale shall be finally settled by the Courts of Evry (France).
